Fishing licence
Could someone please settle an argument that me and a couple of neighbours were "debating".
Scenario..You are lord of the manor and own about forty acres of land and upon said land is a lake, very highly stocked with your own fish. One morning you look out of window and think "by george its a grand day i,ll get the old fishing rod out and bag a few of them big boys out of the lake"
I insist that you still need a fishing licence, even tho you own the land, and it is private property, neighbour thinks i,m talking out of my bottom, also I insist that a water bailiff cannot be refused entry to lake to check licence. He said that the bailiff would be trespassing if he stepped foot upon private land. This scenario would be in England

Within Scotland and Northern Ireland, water bailiffs perform a similar function to that carried out by gamekeepers on land. They must look out for poachers and other lawbreakers, and have powers of search and arrest similar to those of police officers. In England and Wales, these powers are available only to officers who have been appointed (granted a warrant) by the Environment Agency.

In my opinion, for an EA baliff to enter private property IE, A gated property he would need to seek a court order unless invited, this is the same as police, inland revenue and all government bodies, they would not be legally entitled to trespass or break in,
As for the licence itself it doesnt matter if your fishing in a bath tub the fact is your fishing and a licenece is required unless your under the age threshold

Thankyou all for your replies. I will share all your thoughts to my neighbour, and probably still carry on our "debate".

Just had a chat with my E.A mate and he said he has the power to go on anyone's land , private or not , to check for a fishing licence . It doesn't matter if the land is open or fenced and gated , he can still go on . If you try to remove him he can call for police assistance to let him get access . The only time he cannot gain access is if he has to go through your front door (house) to get to the water . He actually has more power than the police because his warrant allows this whereas the police have to apply to gain access . All his words not mine . Hope this clears things up .

Richie
They probably think they have the power
I would very much doubt they can legally that would make them more powerfull than the revenue

For going on private land his warrant allows this but the coppers need to apply if they are challenged , like i said , this is just what Ive been told
